We deal with ERISA DOL and the biggest issues we are seeing issue with Part B on Medicare. They are covered under an employers group health plan, but they started getting denied payment from employers insurance and Medicare is telling them that can't go back a retroactive from the date they should have been enrolled in Part B. They are also being charged the penalty charge.
Some employer offer this to the their retiree, does this become an employer sponsor, or are they considered an individual policy?
